What mediation is
Mediation is a conversation between the spouses assisted by an impartial mediator, aimed at reaching an agreement. The mediator does not decide and does not advise like a judge; they help the parties reach their own arrangements. Mediation is voluntary, and everything said in it is confidential and cannot later be used in court as evidence.
When the court refers you to mediation
A Polish court may refer the parties to mediation at any stage, especially on contested issues concerning children: parental authority, the child’s residence and contact. You are not obliged to agree; mediation stays voluntary. Still, it is worth considering where you will have to cooperate anyway, because a child links the parties for years.
What a mediated settlement gives you
A settlement reached before a mediator and approved by the court has legal force.
